Brady Pocknall was filmed breaking into a business and stealing a first aid kit

Brady Peter Pocknall, 27, of McLachlan Street, and two male co-accused broke the Public Health Act restrictions that were in place on July 26 by hanging out together when they did not live together.

According to police, the three men were walking north together on Edward Street from the Southern Feeder Road at 10.45pm.

They climbed over a wire fence at Australian Temporary Fences and they broke into the onsite building.

Once inside they turned on the lights and ransacked the bins and a desk in the office before stealing the First Aid kit.

A witness contacted the police who arrested Pocknall nearby.

"I've been taking Xanax so I don't know what's going on," he was quoted as telling the police.

However, he also denied taking the prescription drug.

Solicitor Mason Manwaring compared the actions of Pocknall and the two other men with slapstick comedy Keystone Cops.

"He watched the CCTV on my instruction, my client did not have a great recollection of what occurred," Mr Manwaring said.

"They managed to take a first aid kit, they were opportunistic ... serious but stupid."

Mr Manwaring said Pocknall had one previous larceny matter on his record form 2013.

"He says to the [writer of the Sentencing Assessment Report] that he was on illicit drugs but he hasn't done so since," Mr Manwaring said.

Magistrate David Day gave Pocknall a community-based custodial sentence by way of an Intensive Correction Order.

The order is to run for 12 months from November 24 and Pocknall will also have to complete 70 hours of community service. He will also have to participate in rehabilitation and treatment.

"This doesn't appear to be driven by the need to steal to have money to buy drugs," Mr Day said.

Mr Day said Pocknall's offending was aggravated "to a limited extent by some prior matters" but he also said Pocknall also has led a "pro-social life" and is employed.
