According to police, Dahmin Elad Eltham, 21, attracted the attention of an Orange Highway Patrol officer who saw him driving about 30 km/h above the speed limit in Hill Street on September 12.
Eltham, who is homeless, was driving with Harley Young, 22, of McLachlan Street, in the passenger seat and was arrested so police could confirm his identity when he refused to provide his name.
Eltham was stopped at 11.20am and began to physically resist and argue with the police officer and he threw his arms about and grabbed a pole to stop the police officer moving him.
The police officer called for assistance and Eltham let go of the pole to punch the officer in the chest several times.
He was then taken to the ground and continued to fight with the officer whose elbow hit the ground in the struggle and required attention from paramedics for pain and bleeding.
Other police came to the officer's aid.
Young filmed the arrest on his phone and shouted abuse at the officer, hindering the solo officer's ability to arrest Eltham.
At one point Young got closer, ignored the officer's demands to get back so was sprayed with capsicum spray.
He also refused to provide his details to police and refused to put his hands behind his back to be handcuffed so a knee strike was made to his right thigh.
Magistrate Elizabeth Ellis took into account the 24 hours Eltham spent in police custody when she sentenced him to two 12-month Community Correction Orders for resisting police and assaulting a police officer.
She also gave him a nine-month CCO with a six-month driving disqualification and 24-month interlock order for refusing to submit to breath analysis.
Eltham was also convicted without further penalty for speeding, carrying a knife when he was arrested, and for refusing to produce his driver's licence.
Magistrate Roger Prowse fined Young $600 for one count of resisting police and $500 for a second count.
