Dwayne James Reid, 30, of Spring Street, had three warrants out for his arrest when police arrived at his home on October 4, 2020.
Police knocked on the door at 7am and Reid tried to jump out a bedroom window however, when police were let into the house they saw him climb through a man hole in the laundry.
Reid made his way to the eastern side of the roof and covered himself with roofing insulation.
Police surrounded the building and called for more police to help.
After 30 minutes of trying to coerce him out, the police gained entry to the roof cavity by removing roof tiles.
They found him lying on his stomach with a pile of insulation covering him.
He then made his way to the man hole and fearing a violent confrontation the police sprayed him with OC spray.
He was removed from the roof before being handcuffed, arrested and taken to Orange Police Station.
The three warrants had been issued for Reid's arrest on August 31 in Bathurst Local Court, on September 15, and September 21 in Orange Local Court.
Once someone has been in jail for five years consecutively the local court is not allowed to put any [jail sentences] on top of that.
- Magistrate Alison Viney
Reid was already in custody when he appeared in Orange Local Court for sentencing.
Magistrate Alison Viney sentenced him to four months jail, however, the sentence was back-dated to June 16 and has already expired.
Ms Viney also gave Reid a nine-month jail sentence for assaulting a woman occasioning actual bodily harm, and a six-month jail sentence for intimidation.
According to information supplied to the court the victim attended Orange Police Station with a support person at 1pm on September 2, 2020.
When she attended the station police noticed that the right side of her face and eye was swollen and she had bruising, redness and pain as well as bruising to her back. The woman and it was believed she may have had fractures to her rib and eye socket as a result of the assault. A CT scan and x-rays were taken on September 4.
The victim said the accused called her from a rehabilitation centre and when she did not answer her phone he went to her home.
When she answered the door he punched her in the face a number of times. She did not attempt to defend herself but closed her eyes and waited for him to stop punching her.
She fell onto a couch and felt him kick her at least once and once he finished assaulting her he returned to the rehabilitation centre.
Reid called the victim again on September 3, 2020, asking where she was and when she refused to tell him he became enraged and said, "wait 'til I find you motherf***er, I'm going to kill you motherf***er," then hung up the phoned.
Reid was also given a four-month jail sentence and a 12-month driving disqualification for driving while his licence was disqualified on June 21, 2020.
He was also given a two-month jail sentence for possession of 0.5 grams of cannabis.
The jail sentences were all back-dated and expired on October 15, 2020. However, Reid remains in custody for another matter after his parole was revoked and will not expire until January 2023.
"Once someone has been in jail for five years consecutively the local court is not allowed to put any [jail sentences] on top of that," Ms Viney said.
"I am going to give you jail sentences but they are all going to be expired so I'm back dating them."
