Magistrate David Day said he was limited by the sentencing act when when he gave Jay Daniel Phillip Egan, 35, of Davidson Court, a total jail sentence of 12 months without parole.
Mr Day removed the option of parole because he said the combined offences deserved a sentence of 18 months, which was not an option under Section 58 of the Crimes Act.
According to police, Egan had a home-made police-style metal baton in his possession on December 2, 2019. Police found the baton in his bedroom and he was charged with possession of a prohibited weapon.
On March 8, 2020, Egan stole $240.70 worth of groceries from Coles shopping centre when he walked out with a trolley load of items.
A manager challenged him when he left the store and he offered to return to pay for the items.
Later that day Egan was caught driving while his licence was suspended and during a search a woman's credit card that police suspected was stolen, fell out of his pocket.
On May 12, police in Duboo found him in possession of prescription drug Suboxone, and during sentencing he was convicted without further penalty for having a knife in public at the same time.
On June 29, police found capsicum spray in Egan's underwear during a traffic stop in Sir Neville Howse Place, he was also charged with driving while his licence was suspended at the same time.
Egan was also caught driving while his licence was suspended on February 24 and April 26 this year.
In one of the driving matters Egan was driving his partner to hospital and drove 100 metres before he was stopped by police.
For each breach of the driver's licence suspension, Egan was given concurrent 12-month community correction orders and he was disqualified from driving for 12 months.
Mr Day said Egan went into custody on June 20 and served part of his parole from a four-year jail sentence that expired in July.
