Paul Nicholas Bondareff, 48, of Hamer Street, was fined $330 and was disqualified from driving for three months.

He was caught with an alcohol reading of 0.078 after being stopped by police at 11.25pm on March 19 in Anson Street.

Solicitor Mason Manwaring said Bondareff had been drinking at a friend's place and has since completed the Traffic Offenders intervention program.

"He thought he managed his drinking, it is a low range," Mr Manwaring said.

However, police prosecutor Sergeant Carl Smith said the reading was at the higher end of the low range and his traffic history didn't help him.

Bondareff was driving a Ford Falcon sedan when he was stopped for a random breath test and according to police his speech was slightly slurred and he appeared to be moderately affected by alcohol.

After failing the test Bondareff was arrested and taken to Orange Police Station where police said he told them he had four or five stubbies of full-strength beer between 4pm and 11pm.

Bondareff had previously been convicted of mid-range drink driving in 1998.
