THE identity of a councillor who has drawn on Orange City Council’s legal insurance will be discussed on Tuesday, but it is likely their identity will remain anonymous.

In April, councillor Tony Mileto asked for information on whether any councillors had claimed in the past five years.
The report returned in early June mentioned one councillor had and the insurer approved the claim, but Cr Mileto was not satisfied.
“Based on what I’ve been provided, it appears to be contrary to the provisions of the Local Government Act,” he said.
Councillors can claim the cost of legal expenses provided they acted in good faith and proceedings found in their favour.
Costs are not covered if the councillor initiates legal proceedings.
The report said the council paid the excess on behalf of the councillor, but the excess was repaid when the matter was resolved.
Cr Mileto would not comment further until the confidential debate.
