Australian Childcare Solutions contended Senior Commissioner Rosemary Martin erred in her consideration of the council’s bulk and scale guidelines and the proposal’s traffic impact on the residential area when she found in the council’s favour in December.

She found the proposal pushed the site beyond its capacity and on Wednesday, Chief Judge Brian Preston found she had made the correct ruling.
Council planning committee chairman and councillor Russell Turner welcomed the decision.
“[The] council is not anti-business, but we want to see developments that are as much as possible acceptable to the neighbourhood.”
