A MAN accused of sexually assaulting a child at Elephant Park on Friday was not present when he was formally refused bail in Orange Local Court on Monday.

Brendan James Smith, 37, was represented in court by Aboriginal Legal Service solicitor Nidal Abdi on a charge of sexual intercourse with a child under the age of 10 years.
He did not apply for bail and will remain in custody and will appear via audio visual link when the matter is next raised on January 23.
Smith will also have a separate hearing on January 11 for older charges including having custody of a knife in a public place, resisting an officer in the execution of their duty, offensive language in a public place as well as two charges of stalking/intimidation and intending physical harm.
SUNDAY, 6PM:
A MAN has been refused bail after he was charged with sexually assaulting a child in Orange.
Police say about 3pm on Friday a five-year-old girl mistakenly entered the male public toilets at Elephant Park on Woodward Street.
When the girl’s mum went to find her she revealed a man had allegedly sexually assaulted her in the toilet block.
Officers from Canobolas Local Area Command established a crime scene at the location and began their investigations.
Police searched for the alleged offender in the area but were unable to locate him.
At 4pm on Saturday they arrested a 37-year-old man in Moad Street. He was taken to Orange police station and charged with sexual intercourse – child under 10.
The man was refused bail at Orange Local Court on Sunday morning when he appeared by audio-visual link.
He was then transferred to Bathurst Correctional Centre on remand and will face Orange Local Court via audio-visual link on Monday.
