The girl was sexually assaulted after mistakenly entering the male toilets.
A day later, Brendan James Smith, then 37, was arrested in Moad Street and charged with sexual intercourse with a child under the age of 10 years.
He did not apply for bail at the time of his arrest and has remained in custody on remand since November 19, 2016.
Smith was represented by solicitor Nidal Abdi in Orange Local Court on Monday.
In arguing for bail, Mr Abdi said it is almost six months since his client was arrested and said it was a weak prosecution case based on identification provided by a woman who was a year below Smith at school 20 years ago.
The prosecution argued that along with the identification, they are also waiting for the results of DNA tests taken at the time of the offence.
