A MAN refused bail following his alleged role in an armed robbery at Kelly’s Rugby Hotel on Sunday threw his clothes in a creek and tried to disguise himself before finally turning himself in, Orange Local Court has heard.

Nicholas Mundy, 29, and Isaiah Mundy, 18, appeared in court on Wednesday charged with armed robbery in company.
The two men and a 15-year-old boy allegedly entered the hotel’s bottle shop at about 1.20pm.
Opposing bail, police prosecutor Sergeant Phil Donato told the court the 15-year-old threatened and lunged at the store employee with a 20-centimetre knife and when the attendant fled the scene, Nicholas took cigarettes while Isaiah attempted to access the locked cash register.
“They were compliant in the proceedings,” he said.
“[Isaiah] discarded his clothing and attempted to change his appearance to avoid detection by shaving his facial hair.”
Isaiah finally turned himself in at Orange Police Station at 3pm on Monday. Nicholas had been apprehended earlier and Sergeant Donato said the accused told police he would have also turned himself in after seeing his daughter.
He told the magistrate, Terry Lucas the prosecution case was strong due to CCTV footage, admissions made about the incident and forensic evidence, the two were a risk to the community of committing further offences and there was concern they might fail to appear in court considering a jail sentence was likely if they were convicted.
The prosecutor said Isaiah Mundy in particular had received two section nine good behaviour bonds from the court in October last year and had a record of breaching bail and failing to appear in court.
Aboriginal Legal Service solicitor Nicholas Leach represented both men and supported bail, saying before the 15-year-old brought out the knife, neither knew what about to happen.
“Apart from the driving matter in August 2015, there’s been nothing [on Nicholas Mundy’s record] since 2012 and the 12-month good behaviour bond he received, he complied with,” he said.
“[Isaiah] came down to the police station and said, ‘I’m here, I did what the police allege’, he’s made full admissions, not only identifying himself, but his co-accused and advised where he discarded evidence that would have implicated him in the crime.”
Mr Lucas granted Nicholas Mundy bail to live at Dubbo, forbidden from contacting any witnesses, but he denied bail to Isaiah.
“Your record lets you down, you’ve failed to comply too many times,” he said.
The men will next appear in court on March 17, with Isaiah to appear via video link.
The 15-year-old, who was also charged with assaulting police and breaching bail, was refused bail on Monday.
No pleas have been entered.
