McKellar was arrested by police at the weekend and refused police bail, remaining in custody until yesterday’s court appearance.
Police prosecutor Sergeant Beau Riley opposed bail.
“He doesn’t have an enviable record with previous charges for break and enter and stealing, and he’s spent time in custody,” Sergeant Riley said.
“Police allege he will commit offences of the same nature.”
McKellar’s Legal Aid solicitor Bob Lulham told the court his client was on the Methadone program and needed to access the Kite Street community facility for his treatment on a daily basis.
Mr Lulham said McKellar needed to stay in Orange as his aunt is in a coma at Orange hospital, and he plays a role in helping his children get to school.
“He was co-operative with police when arrested,” Mr Lulham said.
He also told the court his client had several broken toes and was in a ‘moon boot’ and would require ongoing medical attention.
Mr Lucas said he took into account McKellar’s previous record involving other offences and the fact he needed to continue accessing the Methadone program, asking Mr Lulham if his client was able to put up any surety.
After conferring, Mr Lulham told the court McKellar’s family was able to put up $500 to have him released on bail.
