Anthony Noel McNamara, 46, was charged in August with a total of nine offences from a two-car crash in Frankston in 2011, that allegedly involved him drink-driving.

Shane Matthew Vincent, a passenger in Mr McNamara's car, died in the crash on April 4 that also injured a man and a woman in a second car.

Mr McNamara also suffered serious injuries, that include an acquired brain injury, which a Melbourne court was told  on Thursday may deem him to be ultimately unfit to be tried.

His solicitor Anna Balmer asked a magistrate at a committal mention of the charges for an adjournment to obtain a neuro-psychological assessment on that issue.

Mr McNamara, who was in court, is also charged with the alternative offences of driving in a manner dangerous that caused Mr Vincent's death and similarly driving to negligently cause him serious injury.

He is further charged with negligently causing serious injury to Tara Leigh Sanders, a passenger in the second car, and with driving in a manner dangerous that caused her serious injury.

Mr McNamara faces other charges that include recklessly engaging in conduct while driving under the influence of alcohol that placed Jonathan Bruce Nicholls, the driver of the second car, in danger of serious injury.

Magistrate Kay Robertson adjourned the case until December.

Noel McNamara became a passionate victims' advocate after the murder of his 29-year-old daughter Tracey in 1992.

He is president of the Crime Victims Support Association and is supported by his wife in what has been an influential pressure group.
