Sean Jethro, 25, of Gorton Street, Yoogali, was employed on a casual basis at a farm in Griffith and solicitor Ken Lambeth said he was working with other people from Papua New Guinea.

"The person he was working for was the victim, he paid them something but he didn't pay them all their wages," Mr Lambeth said.

"The money is very important because they use it to support their families in Papua New Guinea. His parents are subsistence farmers."

Mr Lambeth also conceded Jethro had a "skinful of alcohol" on the night of the offence, March 27, 2020.

Jethro had shared a carton of beer and a bottle of vodka with two friends before the victim, who also lived at the address, confronted them about 9.30pm over the noise they were making.

Jethro then attacked the victim, punching him repeatedly in the face and chest, including after he ran away to the front yard and while he was on the ground.

He also breached an apprehended violence order when he returned to the house while intoxicated the next day and he later failed to appear in court.

Jethro was arrested in the Central West and appeared in Orange Local Court via a video link after being refused bail.

Magistrate David Day said he would usually jail people for such an offence but it was the first time Jethro had come before an Australian court and he would have had to demonstrate that he was a "fit and proper person" to get a work Visa.

Mr Day fined him $550 for the assault and placed him on three 12-month community correction orders for the assault, contravening the AVO and failing to appear in court on June 17, 2020.
