A report to Orange City Council's Planning and Development committee has recommended approval for the takeaway restaurant on Bathurst Road at the former Thomson's Nursery site.
Under the plan the premises would have 42 seats inside and parking for 24 cars including three for staff.
A drive-through facility would be included.
Acoustic fencing would be provided along the southern and western boundary and one tree would be removed on Eyles Street.
It would be open Sunday to Thursday from 10am to 10pm and Friday-Saturday from 10am to 11pm.
When it was put on public exhibition the DA received one objection from a neighbouring resident concerned about increased traffic in the area.
"We would have difficulty accessing our driveway at all times especially peak times and there would be excessive noise from cars due to the late hours of operation," the resident said.
They sought to have access to the restaurant removed from Eyles Street.
However, the council recommendation said the development would not infringe on residents.
"The proposed development is considered to be of minor interest to the wider public due to the relatively localised nature of potential impacts," it said.
"The proposal is not inconsistent with any relevant policy statements, planning studies, and guidelines that have not been considered in this assessment.
"Most of the buildings structures, including the ordering point, loading bay, main building and plant area, are located well away from the southern boundary, although it is acknowledged that the drive-thru is located in close proximity to the southern boundary.
"The construction of the acoustic fence and landscaping along with the site's design should minimise potential impact on adjoining residents.
"The submitted Environmental Noise Assessment Report states the development will meet the relevant noise criteria subject to a number of recommendations."
McDuck Properties owner Hector Abbott said in April the business would complement the other takeway food outlets in the Bathurst Road corridor.
