Jason Trudgett, 44, of Maramba Road, was not accused of stealing the credit card, which had been dropped by a customer in a shop at 11.45am on November 22, 2019.

The credit card was picked up by a co-accused.

According to police Trudgett and two co-accused used the card multiple times via tap-and-go facilities.

Trudgett used the car to buy $81.35 worth of groceries from Coles at 12.25pm that day, at 12.31pm he bought clothes and batteries from Kmart worth $64, and he spent $83.50 on fuel at a Bathurst petrol station.

Trudgett was arrested about 1.15pm and was released on bail.

Solicitor Nico Rump said Trudgett was aware of what he did and showed remorse.

"This offending seems to have been tied up with financial difficulties he was facing due to his unemployment," Mr Rump said.

Magistrate David Day gave Trudgett a seven-month, community-based intensive correction order and 50 hours of community service for all three charges of dishonestly obtaining property.

"This is a prevalent offence. That's why the limit is $100 so the damage is not excessive," Mr Day said.

Mr Day also took into account Trudgett's extensive criminal record.

"In my view these matters do cross the custody threshold and sentences of imprisonment are appropriate," he said.
