A man who assaulted an off-duty police sergeant outside a hotel in Lords Place last year had his full-time jail sentence overturned on appeal.

Jake Samuel Macartney, 24, of The Avenue, Peregian Springs, Queensland, was initially given 12-month' jail with a six-month non-parole period for the assault.
However, on appeal he was resentenced to a two-year intensive correction order, which is a community-based custodial sentence with conditions he take part in treatment programs.
For resisting the police officer, he had also been given a two-year community correction order and $1100, which was reduced on appeal to $500.
Macartney tried to tackle the police sergeant and wrestled with him on the ground on the footpath after Macartney was made to leave the pub due to intoxication on October 19.
Other people had to help restrain him until more police arrived.
The sergeant received scratches to his face and neck, a ripped shirt as well as a broken watch.
