AN elderly man who fell asleep at the wheel at Lucknow and caused serious injuries to the occupants of the other car will not serve his sentence behind bars after appealing the sentence in Orange District Court.

Raymond Morris Harrison, 66 of Algona Crescent had been sentenced in Orange Local Court to 18 months' full-time custody in March, with a non-parole period of nine months, for two counts of dangerous driving causing grievous bodily harm and one count of causing harm after his Mitsubishi Triton utility crossed onto the wrong side of the road on the Mitchell Highway in February last year.
The ute struck a Mitsubishi Lancer head-on - the 60-year-old woman inside suffered severe leg fractures, which required multiple surgeries, while the 60-year-old man broke his lower leg, which also required surgery.
An 83-year-old woman in Harrison's vehicle suffered four broken ribs.
However, Acting Judge Geoffrey Graham ruled on Tuesday the sentence should be served in the community as part of an intensive corrections order.
Harrison's was one of three sentences revised this week.
Clinton Robert Costello, 35, of Fox Avenue had his three-year jail term cut to four months on Friday, making him eligible for release.
Costello had threatened ambulance officers with his fists after several calls to Triple-0 between December 27 and January 3 and then threatened a police officer before he was subdued with capsicum spray.
Meanwhile, Randi Ann Birkin, who had received a conviction without further penalty for punching a man in the face had her conviction overturned.
Katelyn Jane Clarence, 24 of William Maker Drive, who faced sentence for punching a female senior constable in the face, causing swelling to her nose and lip and possible future loss of her two front teeth, will have to wait another nine months for a final result.
According to police, officers pulled her car over on Burrendong Way on March 31 based on information she was driving under the influence of alcohol but after her arrest, she resisted a search and punched the officer who searched her.
She will live with her father just outside Griffith and attend rehabilitation to demonstrate she can be of good behaviour.
However, Judge Graham warned her she could still face a jail sentence next February, even if she did show improvement.
