Baymus Fernando, 34, of Nelson Place, was arrested at the closed petrol station about 10.15pm on February 18.
He appeared before magistrate David Day who sentenced him for aggravated break and enter and steal, resisting arrest, and possessing housebreaking implements.
According to police, at 7pm an employee removed cash and cigarettes from the Mitchell Highway petrol station and the store was locked.
... police grabbed him and dragged him out, and said there was a brief struggle.
However, shortly before 10.15pm Fernando and a co-accused parked a blue Ford Falcon at the back of the premises.
Police said the pair tried to force their way through several windows, and were seen by a member of the public who contacted the police.
They managed to remove a fly-screen and window frame from a back window and police said Fernando then went inside and stole five cigarette lighters, which he put in his pockets.
When police arrived they arrested the co-accused outside but then found Fernando hiding inside the building.
When he was told he was under arrest Fernando refused to come out, so police grabbed him and dragged him out, and said there was a brief struggle.
After police arrested him they found a tyre iron near his hiding spot. He also had a torch in his pocket.
Fernando was given a total three-year jail sentence with a 12-month non-parole period dating from February 19 for the three offences.
A need for community-based drug rehabilitation was taken into account as part of the sentence.
- Fernando appealed his jail sentence in Orange District Court on Monday, August 19, where Acting Judge Geoffrey Graham reduced the overall jail sentence to 18 months with a seven-month non-parole period making him eligible for release on September 18, 2019.
