Nevada Payne, 21, of Spring Street, was drinking in the upstairs area of the Hotel Orange on New Year's Day.
However at 12.40am the RSA marshall approached him and told him to leave.
I'm not going to [tell him to] be a teetotal but he has to have a better understanding of where his limits are.
- Magistrate David Day
According to police, as Payne was being escorted out he became aggressive and belligerent towards the marshall and a security guard.
He threw a glass bottle at the marshall, who ducked and the bottle smashed on the bar, attracting the attention of a police officer who was out the front of the hotel.
The senior constable helped escort Payne out, but when he went to handcuff him Payne spun around and punched him in the face.

He also gave him an an intensive correction order of eight months along with 30 hours of community service for common assault, a 12-month community correction order and 30 hours of community service for resisting police, and he was convicted without further penalty for refusing to leave the hotel.
"I'm not going to [tell him to] be a teetotal but he has to have a better understanding of where his limits are," Mr Day said.
Police prosecutor Sergeant Beau Riley said the injured officer required an ice-pack for pain, couldn't chew or eat solids after the punch and his recovery took about a week, however there was no lasting damage.
Solicitor Curtis Penning said Payne had no recollection of what happened on the night.
