SCOTT Michael McDonald has not succeeded in having his conviction overturned for drug possession after appealing to the district court.
The 31-year-old's solicitor, John Song, asked for the strip search by police on March 30 last year to be deemed unlawful.
Police asked the Pindari Place man to remove his pants in the back of a police van and spotted 1.7 grams of ice under his testicle.
However, Judge Peter Berman said it was clear police had reasonable grounds to search McDonald because the statement indicated McDonald had a run-in with police the day before, and so he dismissed the appeal.
