Matthew McDonald, 23, of Pinnacle Road, was charged with inciting the man to resist a police officer during the execution of duty.
His mobile phone footage was shown in court and magistrate David Day said he incriminated himself with it and “alcohol was at play”.
Basically he was encouraging the person who was being arrested, who was being restrained by [the sergeant] to continue resisting.

“Basically he was encouraging the person who was being arrested, who was being restrained by [the sergeant] to continue resisting,” Mr Day said.
According to police, the incident started after the other man was told to leave an Orange hotel by a bar manager at 9.30pm on October 10, and when he refused to comply an off-duty police sergeant, who was socialising at the hotel, stepped in to help.
Solicitor Mason Manwaring said McDonald saw a man on top of his friend outside the pub and initially tried to pull him off but stopped as soon as he was told the man was a police officer but then started filming the situation on his phone.
McDonald was fined $880 for the offence and the other man has pleaded not-guilty with a hearing scheduled for July.
