Matthew Tumai, 43, of Lawrie Street, Gracemere, appeared in Orange Local Court on Monday to be sentenced for mid-range drink-driving.
According to police, officers were patrolling Byng Street at 11.50pm on September 29 when they saw Tumai’s car, which only had one working tail light.
Police stopped him near the intersection of Lords Place.

When told about the light he said, “I know, I’ll get that fixed.”
He was then breath tested and returned a positive result and was taken to the police station for breath analysis, police walked around the front of the car and noticed a front headlight was also not illuminated due to the bulb being blown.
At the police station, Tunai returned a mid-range reading of 0.113.
Magistrate David Day gave Tumai a nine-month conditional release order, which was the equivalent of a good behaviour bond, and his driver’s licence was disqualified for three months.
Mr Day also convicted him without further penalty for the defective tail light and head light and he warned him against drinking alcohol on an empty stomach in future.
“If you drink booze on an empty stomach, the alcohol goes straight to the small intestine where it’s taken up very quickly, that’s the importance of food,” Mr Day said.
