The 25-year-old man was sentenced for offences made against his mother on Christmas Day.  

The man who is not named to protect the identity of the victim, was given a conviction without further penalty for destroying property after he smashed a glass cup in his mother’s house.

Magistrate David Day said the more serious offence was intimidation against the man’s mother for which he gave him a 12-month conditional release order, which was the equivalent of a good-behaviour bond.

“He just needs to grow up, he acts out like a 12-year-old,” Mr Day said.

“The mum’s the victim here, she’s hosting the family and she’s frightened and her property is damaged.”

According to police, the man was staying at his mother’s house for Christmas and when he woke up on Christmas morning he began shouting and abusing his mother and other extended family members who were in the house.

The victim phoned police three times and officers arrived and spoke with the accused who remained at the house.

However, after police left, the man resumed his earlier behaviour and threw a glass down a hallway causing it to smash so police were called again and he was arrested.

Solicitor Jo Collings said on the night before the incident her client was assaulted by his brother and when he woke up he was in a lot of pain.

“Things had been said and that’s how he came to upset his mother and throw the glass,” she said.

“He tells the court that he’s sorry that he upset and frightened her.”
