ONE boy has been granted bail and a second remains in custody after allegedly stealing 100 packs of cigarettes from FoodWorks on Sunday.

The pair, aged 17 and 13, faced Orange Children’s Court on Monday charged with aggravated break and enter.
The 17-year-old is expected to apply for bail on Wednesday, with solicitor Ben Tonkin telling the court accommodation was being sought with Veritas House.
Mr Tonkin was able to apply for bail for the younger boy on Monday, saying he had secured accommodation with Anglicare.
Prosecutor Sergeant Beau Riley opposed bail, saying the police had a strong case and the child had breached bail in the past.
“The main concern is committing further offences – there appears to be little or no supervision,” he said.
“The [bail] address is [near] the premises being broken into.”
Mr Tonkin said the child had been “going fairly well” until recently, attending school for an hour a day.
“Which for him, was a significant improvement,” Mr Tonkin said.
Mr Tonkin said his client was having problems with his medication.
“He says it makes him feel bad,” he said.
Reading from the police report, magistrate David Day noted the cigarettes were allegedly found in the boy’s backpack and he referred police officers to his co-accused.
Mr Day estimated the cigarettes’ value at $4000-$5000, but granted bail provided he adhered to a curfew, attended school, took his medication and did not set foot in the Alpine Stores’ shops.
The 13-year-old has pleaded not guilty to the offence and will face court again in December.
