The demolition and replacement of the service station at Lucknow has received a staff recommendation for approval provided the opening hours are restricted to 7am until 10pm.
Applicant Brothers Three had applied for a 24/7 operation, but met opposition from neighbours.
Council staff found light glare and how 24-hour operation would affect the village were not addressed by the applicant and did not accept an offer of 5am to midnight.
“It is considered that a 24-hour operation has a high probability of causing significant nuisance to the local residents,” the report said.
“[It] will have difficulty meeting or reinforcing the objectives of the village zone, where mixed residential and commercial land uses must be sufficiently benign to achieve reasonable co-existence.”
Meanwhile, Byng Street Local Store’s modified extension has also been recommended for approval, with the previous so-called “glass box” redesigned.
The council last considered the pavilion-style proposal to cover the outdoor dining area in December, but deferred it pending further discussions with the applicant and objectors.
A meeting was held in May and the applicant removed the ventilated windows facing Clinton Street in favour of a roofline in keeping with the rest of the building.
Bi-fold doors were also removed and the toilets were enclosed to address noise concerns.
With the business only able to change the building with modifications because restaurants are no longer allowed in the zone, staff were satisfied the proposal met the test.
Councillors will consider both applications at an extraordinary meeting, due to the need to shorten Tuesday night’s usual meeting, relocated to Spring Hill.
