Beau Dylan Dinsdale, 21, of Casey Crescent, appeared before magistrate David Day in Orange Local Court on Monday and was given another 12-month driving disqualification as well as a 200-hour community service order.
“Don’t drive, you will be detected, you are now at the point of going to jail for an offence of this nature,” Mr Day said.
It was the fourth time Dinsdale had been charged with an unlicensed driving offence.
“I’ve decided to make it clear to Mr Stapleton and Mr Dinsdale that if he keeps on doing it he will be going to jail,” Mr Day said.
“He’s at serious risk of being one of the one-in-10 prisoners in NSW in jail for driving while disqualified.
“This is his last way point before he navigates his way to jail, he could make a course correction or he could navigate his way to jail.”
Mr Day said Dinsdale should have told the other people in the car that he couldn’t drive.
Dinsale was caught driving on the M1 Motorway, Waharoonga on July 12 at 9.35am with two other licensed drivers in the car.
However, his solicitor Gerry Stapleton said he was driving because a fully-licensed driver had been driving but asked Dinsdale to take over due to a migraine headache.
Mr Stapleton said the other licensed person in the car only had a learner’s permit and would have needed a licensed driver to supervise.
“He’s aware that it’s a jailable offence,” Mr Stapleton said.
“He got a taste of custody by spending two hours in the dock.”
