Kyle Berryman, 21, of Carcoar Road, Spring Hill, was sentenced last month in Orange Local Court to 20 months’ jail, with a non-parole period of 15 months.
Berryman and co-accused Samuel Woods were driving through a property at Tomingley on August 14 and 15, 2016.
The first film contained footage of a kangaroo with a knife embedded in the top of its head before it was pulled out and the second showed a knife being thrown at the kangaroo.
The final image was of the co-accused, holding a limp kangaroo.
Woods has not yet been sentenced.
During severity appeal proceedings in Orange District Court, solicitor Mason Manwaring said the pair may have been trying to euthanise the kangaroo after accidentally hitting it in a car.
“The way it was dealt with is absolutely inappropriate, hence the plea,” he said.
“It was a first offence and he was assessed as suitable for community service and it’s my respectful submission that given those factors, an intensive corrections assessment could follow.”
However, Judge Julia Baly said other than Berryman’s own statement, the evidence was inconsistent with the explanation and Mr Manwaring asked to have until next week to gather the material.
