However, on Monday Judge Christopher Robison granted an appeal by Grant Robert Hughes, 33, of Lisbon Circuit, that back-dated the disqualification.
Hughes was given a two-year driving disqualification on August 31 after pleading guilty to negligent driving causing death.
It was to be back-dated to when his licence was suspended and would have meant he could have reapplied for his driver’s licence after one month.
However, the RMS refused to back-date the disqualification instead dating it from August 31 to August 2019 because the police suspension had been for a more serious charge which was later dismissed.
The charge related to a crash that killed Mirko Barbaric on July 28, 2015, after Hughes’ ute crossed into his path due to a defect in the rear suspension.
