Aaron James Corby, 36, of Hawkins Lane, was heavily intoxicated and had been excluded from a hotel in Summer Street before he was arrested.
For spitting on a police officer’s trousers, Corby was charged with assaulting a police officer and was ordered to complete 200 hours of community service.
He was also given a 15-month good-behaviour bond for resisting police.
For remaining in the pub’s vicinity despite being excluded on September 9, Corby was also fined $220.
He was given the same fine for failing to leave the premises when he was excluded.
His solicitor Mason Manwaring said there were no other matters of violence on his client’s criminal record.
“As I understand the assault, the only thing I glean from it is it was after two bursts of capsicum spray, the capsicum spray would have caused discomfort and he would have turning his head to spit that out,” Mr Manwaring said.
Corby was sprayed twice with capsicum spray for not obeying police directions such as giving his name.
He also swore at police and put his hands across his chest to avoid being handcuffed.
Police approached Corby after seeing him banging on the hotel’s window and trying to get past a security guard to get inside at the main entrance.
He had already been refused services four times and on the last occasion lay on the floor and had to be physically picked up by security staff.
Corby was arrested after repeatedly disobeying directions and had been warned more than once about spitting near police.
