He said he had consumed nine stubbies of full-strength beer that day.
Police gave Adam Leslie Gosling, 34, of Wentworth Lane, 10 minutes before breath testing him on Wentworth Lane at 8.54pm on May 12.
However, Gosling returned a positive result and was arrested and taken to Orange Police Station where a breath analysis recorded a mid-range reading of 0.126.
As a result magistrate Alison Viney fined him $800 and disqualified from driving for six months in Orange Local Court last Tuesday.
“That’s a reading that shouldn’t have you anywhere near a vehicle,” Ms Viney said.
Gosling was represented in court by solicitor Mason Manwaring who said it was his client’s first time in court for that type of offence.
