The order was taken out against Joshua Meijer who ran the hotel with his wife through City Country Hotel Management in 2013 until the owners took back possession on December 6, 2016.
The AVO was initially lodged in December 15, 2016, to protect the building’s owners Michael, John and Anne Fabar from Dark Sphere Solutions in response to threats against the hotel.
A key piece of evidence was an email from Mr Meijer’s address sent on November 11, 2016, to Mick Fabar as part of a string of emails under the subject Re: Outstanding rent and outgoings.
The email read, “Tell the F…wit Fabars that we will pay the rent in full at the end of the three year term, or we can burn the hotel down now or later and they wont [sic.] have anything to worry about, the building is stuffed anyway. By the end, they will pay out or we will leave them with a nonoperable [sic.] licence and hotel with nothing in it or we get the value out of other stuff they own.”
Mr Meijer previously stated he did not send the email and on Monday, January 23, he appeared in Orange Local Court where he disagreed with the AVO and requested a hearing date.
However, he did not attend court for the hearing on Thursday and the order was granted after Michael Fabar swore an oath saying information submitted to the court was true and correct.
In a statement submitted into the court, there were issues between the two parties for 12 months in relation to the lease and Michael Fabar was the primary contact with Mr Meijer but it was alleged that during conversations Mr Meijer became hostile, used hostile language and threatened Michael Fabar and the property.
The order will prevent Mr Meijer from entering the Hotel Orange and approaching or contacting the Fabars except through a lawyer.
It also stated he must not assault, threaten, stalk, harass, intimidate, intentionally or recklessly destroy or damage property belonging to the Fabars and will be valid until March 29, 2018, but will not come into affect until it is served on Mr Meijer.
In a document from December 14, 2016, Mr Meijer said he was concerned the AVO was about damaging his reputation ahead of a supreme court hearing into the hotel lease.
