Nathan Toomey, 31, of Dalton Street had been taken home by police about 3am on October 15 after being found intoxicated in the bathroom of the BP petrol station in Summer Street.
However, police said he became aggressive when he arrived home and said he wanted to fight the police.
As they were leaving, he spat on a constable through the open car window so he was arrested for assaulting police.
Toomey pleaded guilty to the assault police charge and was represented by solicitor Tim Dalla who said although there were a number of matters of violence on his client’s record, there was nothing of this nature. Mr Dalla said he was extremely drunk and had no memory of his behaviour.
“I’m glad that you don’t remember what you did in one way, but in another way it disgusts me. If you are before me again on this you will go to jail,” Mr Lucas said.
