He said members of the Orange Ratepayer’s Association had not discussed whether they would field a candidate in the by-election.
The group had three members run for council during the local government elections in September 2012.
Mr Da Rin said he pursued Mr Duffy’s election in the Administrative Decisions Tribunal because the association’s members had made an executive decision to do so, as they believed he did not live in Orange.
Mr Da Rin said the case was never personal.
“I stressed that to the judge in February last year, that the application was done incorrectly, there should have been no reference to me, only the ratepayers,” he said.
Mr Duffy earned about $17,000 in the first 12 months of being an Orange councillor.
If Mr Duffy does not appeal the tribunal’s decision, an election must be held between January 5 and April 5.
Mr Da Rin said the funds for the hearing had been donated by “various people” but would not say how much because he intended to apply for costs.
