Time’s up for owner to come clean

FOR the second time in two years an Orange homeowner may have failed to comply with orders by the NSW Land and Environment Court to clean up her Windred Street property.

An impending inspection will determine if Sophia Kjoller has not used the three months granted to her by the court to clean up the piles of rubbish in the front and back yards of her home.

In October last year, Land and Environment Court Justice Pepper found Ms Kjoller had failed to comply with a March 2008 court demand to clean up the property and ordered the work be carried out by January 31, 2010.

Orange City Council believes the property, littered with boxes, books, clothing and glass jars, represents a health risk.

Four days have passed since the January 31 deadline and while some improvements have been made, the property remains largely unchanged.

It is unclear if Ms Kjoller has complied with orders to reimburse Orange City Council for court costs associated with taking the homeowner to the Land and Environment Court.

During the October hearing, Ms Kjoller submitted an affidavit stating the large property was “a lot for one person to manage”.

She also claimed any vermin in her yard were likely to have come from a neighbouring lot, not hers, and that Orange City Council was harassing her despite knowing her poor health was a reason behind her failure to comply with the first set of orders.

Ms Kjoller submitted evidence to support claims she suffered from arthritis, an injury to her left shoulder and was in remission for breast and bowel cancer.

The Central Western Daily yesterday made several unsuccessful attempts to contact Ms Kjoller for comment.

Orange City Council is prohibited from discussing the details of the case because Justice Pepper ordered council staff to comply with a section of the Local Government Act that prevented it from publicly releasing personal information.

Orange City Council communications and public relations manager Nick Redmond did confirm Ms Kjoller had been notified that an inspection was pending.

“Once that’s done we will consider our position,” he said.

you should be ashamed OCC harrasing a sick women.. why dont you send a roadwork crew round there to tidy it up for her they stand around doing nothing anyway. Im sure the rate payers would be happy with this

This woman has cancer and arthritis but the Council are still bullying her? Is it just me or does this seem a bit rough. Perhaps some volunteers could go and help her instead of dragging the poor thing through court.

the fact is she should never have let it get this way in the first place, what a disgrace!!!! there are community organisations to help people that cant cope with things themselves. OCC are trying to protect the rest of the community, why do they constantly cop the blame

The rats are from a neighbors place, I am old and cant manage the property, etc etc enough with the excuses, get out and clean it up. Your cancer is in remission so you are not currently sick and if the property is too much to manage, then maybe its time to move to something more manageable. Why is it people are no longer responsible for the trouble they cause, its always someone else's fault ?

Cannot agree more with the comments above. Remember the good old days when neighbours would help one another, when council represented the town's wishes. Here's a challenge - How about the mayor and his councillors actually DO something - roll your sleeves up and lend a hand instead of wasting our rates on court action.

good on you council for taking her to court! SHE let the property get this bad SHE should have to clean it up, she's had 2 years to clean it or pay someone to clean it and has done nothing. If she cant manage the property she should sell it and not expect others to clean up for her.

sure, make a mess and expect the council to clean it up. Who do you think is going to pay for this Ms Kjoller??? don't think so its more of your taxes doing work they shouldnt be spent on. where are her family and friends, maybe they can help her. you make the mess, you clean it up. i have spinal arthritis but still manage to keep my home clean

It should never have got into that state in the first place. People are responsible for their own actions. If she can't do it herself, she should pay someone to do it on her behalf.

There is an element of compassion that we should all have for this woman. Hording junk is also a psychological illness and many do it out of fear of losing things in life or their life. It's a psychological issue many have when things in life become too overwhelming for them. However, if this property is too huge for her to handle then she should have sold up and gone into an apartment instead. Lets be practical here! If something isn't working out then you take the steps to fix it.
