FOR the second time in two years an Orange homeowner may have failed to comply with orders by the NSW Land and Environment Court to clean up her Windred Street property.
An impending inspection will determine if Sophia Kjoller has not used the three months granted to her by the court to clean up the piles of rubbish in the front and back yards of her home.
In October last year, Land and Environment Court Justice Pepper found Ms Kjoller had failed to comply with a March 2008 court demand to clean up the property and ordered the work be carried out by January 31, 2010.
Orange City Council believes the property, littered with boxes, books, clothing and glass jars, represents a health risk.
Four days have passed since the January 31 deadline and while some improvements have been made, the property remains largely unchanged.
It is unclear if Ms Kjoller has complied with orders to reimburse Orange City Council for court costs associated with taking the homeowner to the Land and Environment Court.
During the October hearing, Ms Kjoller submitted an affidavit stating the large property was “a lot for one person to manage”.
She also claimed any vermin in her yard were likely to have come from a neighbouring lot, not hers, and that Orange City Council was harassing her despite knowing her poor health was a reason behind her failure to comply with the first set of orders.
Ms Kjoller submitted evidence to support claims she suffered from arthritis, an injury to her left shoulder and was in remission for breast and bowel cancer.
The Central Western Daily yesterday made several unsuccessful attempts to contact Ms Kjoller for comment.
Orange City Council is prohibited from discussing the details of the case because Justice Pepper ordered council staff to comply with a section of the Local Government Act that prevented it from publicly releasing personal information.
Orange City Council communications and public relations manager Nick Redmond did confirm Ms Kjoller had been notified that an inspection was pending.
“Once that’s done we will consider our position,” he said.
