One parking rule that doesn’t add up for Mark

One parking rule that doesn’t add up for Mark

12 Mar, 2010 07:05 PM
MATHEMATICS teacher Mark Griffin is having a little trouble calculating the probability of being fined for breaking a law he never knew existed.

Mr Griffin was fined $141 earlier this week after traffic police found his Toyota Corolla parallel parked out the front of his Clinton Street home facing the wrong direction.

It is illegal to parallel park a vehicle facing oncoming traffic.

Cars must be parked in the direction of the traffic for safety reasons when leaving the kerb.

Mr Griffin said he had no idea what he did was an offence and suspects other residents might be similarly unaware.

He said the majority of his colleagues were also unaware of the rule when he told them about being issued with the fine.

The penalty notice was issued at 9.47pm on Monday night.

“I came out in the morning and saw the notice on the windscreen, read it and thought it was just ridiculous,” Mr Griffin said.

“I was surprised, I honestly did not know you weren’t allowed to do it.

“Granted, it’s not an excuse because I now know it definitely is illegal, but it’s just absurd being fined at that time of night.”

Mr Griffin now parks his car in the right direction.

I was once fined for the same thing about thirty years ago. If I remember correctly it's called "failure to park near and close". Sounds like a redundancy, but it means that you must park on the near side of the road for the direction you're driving in and you must park close to the gutter or as far from the centre line of the road as is practically possible. But you're right; if you don't end up caught by this one, you're not likely to know it exists. The NSW Roaduser's Handbook is irritatingly unclear about this potential infraction of the parking rules.

Well it looks like maybe back to school for you Mark and your colleagues too.

This law has been on the books and enforced for years now. Kudos to him for having the courage to go to the media to reveal how out of touch he is.

To say you didn't know is one thing ...but common sense should have told you that it is not what you do.... open your eyes...it has been law for decades.

Is this news? You were in the wrong, pay the fine and stop carrying on like a pork chop!

That law hasn't changed since I got my licence about 30 years ago, so I guess it's a classic example of a lot of Orange drivers (and parkers) ignoring the rule book.

Maybe the RTA should give everyone a Road Users' Handbook when they renew their licence as all these rules are in it. Also more people should take the time to read it to refresh their memory on the rules they should have known when they got their licence in the first place.

Its not so absurd when you consider it may well be dangerous parking like that at night, particularly if it may be foggy or limited visibility. A few years ago on a country road near Blayney a farmer stopped his ute facing the wrong way, another car approached from in front in very poor visibility and went to pass on the drivers side of the parked vehicle and killed the person standing next to his vehicle that had parked facing the wrong way. Not to say this situation would be very likely to eventuate in suburban Orange, however it is also unlikely that you will have an accident by just talking on a mobile phone but it is still accepted as being an offence for which tickets can be and are issued.
